Sense-Ability Privacy and Data Protection Policies

Sense-Ability reviews its privacy, confidentiality and data protection practices periodically to ensure compliance with applicable legislation, professional standards and regulatory guidance.

Jane Pendry is the lead Data Controller for Sense-Ability Hypnotherapy and Coaching.

Jane is responsible for maintaining all client records securely, and for determining all Policies detailed in the T&Cs including ensuring any affiliates abide by GDPR regulations and these T&Cs.

Privacy Policy

Sense-Ability is committed to protecting your privacy and processing personal information lawfully, fairly and transparently. The legal bases for collecting and storing data are:

  • consent

  • performance of a contract

  • legal obligation

  • legitimate interests

  • safeguarding where applicable

Sense-Ability complies with applicable UK data protection legislation, including the:

  • UK General Data Protection Regulation (UK GDPR)

  • the Data Protection Act 2018

  • the Privacy and Electronic Communications Regulations (PECR)

  • the Data (Use and Access) Act 2025

  • relevant guidance issued by the Information Commissioner’s Office (ICO) last updated in 2026.

    Sense-Ability aims to balance competing interests regarding client privacy and data protection, with legal protection for Sense-Ability and safeguarding of clients.

  • Personal information is collected only where necessary for the provision of services, safeguarding responsibilities, legal obligations, legitimate business purposes, or where consent has been provided.

  • Personal Data gathered through the Sense-Ability online booking system includes personal contact details and optional information relevant for therapy which is securely stored.

  • Sense-Ability processes and stores essential data to enable the operation of its services.

  • Some of our service providers (eg Squarespace, Square and Acuity booking) may process personal data outside the UK. Where this occurs, appropriate safeguards are used in accordance with UK GDPR.

Processing means:

  • collecting and storing essential contact details

  • consent to terms and conditions

  • basic details about services you are enquiring about

  • other optional information gathered by secure questionnaire for use by Sense-Ability as outlined elsewhere in these T&Cs. In other words data you have chosen to share.

If you feel in anyway uncomfortable about your data being processed and stored on the secure Sense-Ability computer (set to highest level of security), please book and pay directly with Jane Pendry (payments can be made directly via PayPal, IZettle link, or bank transfer).


Legitimate Interests

Sense-Ability relies on a lawful basis for processing personal information called legitimate interests.

As a therapist, Jane, and any affiliates, need to collect and process certain personal information in order to provide safe, effective, and professional therapeutic services.

Purpose: The personal information I collect is used to arrange appointments, communicate with clients, maintain clinical records, assess therapeutic needs, ensure client safety, and meet professional, ethical, and legal obligations.

Necessity: I only collect information that is necessary for the provision of therapy and the management of my practice. This may include your name, contact details, relevant health and wellbeing information, emergency contact details where appropriate, and records relating to our therapeutic work. I do not collect more information than is reasonably required for these purposes.

Balance: I carefully consider the impact of processing personal information on your privacy and take steps to ensure that your rights and interests are protected. Information is kept secure, confidential, and only accessed when necessary.

Sense-Ability collects personal information required to provide therapy to my services effectively, ensuring that my legitimate interests do not override your rights and freedoms.


Complaints Procedure

Data Protection Complaints

If you have concerns regarding how Sense-Ability collects, stores, uses or protects your personal information, you may raise a complaint directly with Sense-Ability.

Complaints should be submitted in writing to Data Controller, Jane Pendry

Upon receipt of a complaint, Jane at Sense-Ability will:

• acknowledge receipt within 30 days;

• investigate the concerns raised;

• provide a response without undue delay;

• explain any action taken or proposed

• advise you of your right to contact the Information Commissioner’s Office (ICO) if you remain dissatisfied.

GDPR & Data Protection Policy

By Reading Through Sense-Ability’s Data Protection & Privacy Policies, you understand the relationship between Jane Pendry at Sense-Ability, and yourself or your child, under law.

The Data Protection Policy details the kinds of client records that may be created and retained.

You understand that:

All information clients choose to give Sense-Ability is confidential, and stored safely in line with the latest Data Protection Regulation, including GDPR.

The lead data controller, Jane Pendry, and any affiliates under contract will keep paper records that relate to you in a locked cupboard. All online contact details and permissions are kept on an encrypted file, in an encrypted folder, as required by UK law and GDPR.

Personal records are normally retained for up to seven years after therapy ends. This reflects legal obligations, insurance requirements, professional guidance and safeguarding considerations.

The minimum requirement for retaining paper records of client sessions, determined by Holistic Insurance, is 5 years.

Paper records will be shredded or burned within that seventh year.

Reasonable Use

Jane Pendry will use your contact details for all reasonable communications related to your therapy, and to update you on any changes in services, prices or conditions for a limited period.

  • Updates related to price changes, changes in policies or services may be sent to current and recent customers periodically

  • A link to Sense-Ability news updates on the Sense-Ability website may be included in the signature strip of general email communications.

  • You will not be sent any regular Sense-Ability marketing communications via email such as e-newsletters or email campaigns unless specific permission has been secured.

  • Neither contact details nor personal information are shared, nor passed on to third parties for marketing purposes, except where there is a serious safeguarding issue (you or your close family member are in imminent danger of death, injury or abuse, as outlined under the Safeguarding Policy).

The right to erasure

Right to erasure is sometimes referred to as the “right to be forgotten”.

The ICO which interprets GDPR and laws around data protection, states that you have the right to have your data erased from all records and databases on request.

  • You have the right to have any paper records pertaining to you to be minimised and anonymised on request. See note below. ICO guidance on retention policies can be found here.

  • You have the right for your data to be erased for marketing purposes, even if you previously gave consent to marketing communications. This means you have the right to ask for your contact details to be removed from the Sense-Ability database once therapy has finished.

  • You may request deletion of personal information held about you where one of the grounds for erasure under applicable data protection law applies.

  • Where a request for erasure is received, Data Controller, Jane Pendry at Sense-Ability, will assess the request and respond in accordance with applicable UK data protection law.

Please note that this right is not absolute. Sense-Ability may be required to retain certain information where retention is necessary for legal obligations, safeguarding purposes, insurance requirements, the establishment, exercise or defence of legal claims, or other lawful grounds permitted by legislation.

Clients may also request specific personal information disclosed in sessions is not to be recorded eg “I don’t want you to include my next disclosure on the written notes.”

The Right to Rectification

You have the right to request correction of inaccurate or incomplete personal information held by Sense-Ability. Requests will be considered and actioned in accordance with applicable data protection legislation.

Subject Access Requests

You have the right to request access to the personal information held about you.

You may ask for a copy of any notes or records related to you, and held by Sense-Ability. These must sent within a month of being requested.

Requests may be made in writing or verbally, although written requests are encouraged to help ensure they are processed accurately.

in most circumstances, personal information will be provided within one calendar month of receipt of the request, although this period may be extended where permitted by law.

Where permitted by legislation, Sense-Ability may request proof of identity before releasing personal information.

The DUAA (2025) clarifies Sense-Ability only need to make ‘reasonable and proportionate’ searches when you asks for access to your personal information.

If you are unhappy with the way your personal information has been handled, you have the right to complain to the Information Commissioner’s Office (ICO). We would, however, appreciate the opportunity to address your concerns first.
